Do I have to follow Islamic inheritance rules in my will?
Yes. As a Muslim, your estate should be divided according to the shares set in the Quran. You're free to give up to one third to people or causes who aren't automatic heirs, such as charity or non-Muslim relatives. In Western countries, you need a legally valid will to make this happen, because local law won't apply Islamic rules automatically.
Shares set by Allah
The Quran sets out who inherits and how much: spouses, children, parents and sometimes siblings (Quran 4:11–12). These shares are a command, not a suggestion.
The one-third rule
When the companion Sa'd wanted to give away his wealth, the Prophet Muhammad ﷺ allowed one third, saying: "Yes, one third, yet even one third is too much. It is better for you to leave your inheritors wealthy than to leave them poor" (Sahih al-Bukhari 2742).
So you can leave up to one third to:
- Charities or a mosque.
- Non-Muslim family, who don't inherit automatically.
- A stepchild, adopted child or friend.
No extra for heirs
The Prophet ﷺ said: "Allah has appointed for everyone who has a right what is due to him, and no bequest must be made to an heir" (Sunan Abi Dawud 2870). You can't use the one third to give a Muslim heir more than their share, unless the other heirs agree after your death.
Non-Muslim family
Muslims and non-Muslims don't inherit from each other under Islamic rules. If you're a convert with non-Muslim parents or children, you can still provide for them through the one-third bequest or gifts during your lifetime. See Can I inherit from my non-Muslim parents as a Muslim?
Making it legal in the West
- Without a will, intestacy laws in the UK, Europe or the USA divide your estate in a non-Islamic way.
- Use a solicitor or lawyer who understands Islamic wills, or a Muslim will-writing service.
- Include funeral wishes like a Muslim burial, and guardianship for children.
- Pay debts first: debts and funeral costs come before any inheritance.
- Islamic inheritance shares are set by the Quran.
- You can freely give up to one third to non-heirs.
- No extra bequest to an existing heir.
- Write a legally valid Islamic will.
