What if my employer bans the hijab?
It depends on where you live and why the ban exists. First check your legal rights, because many hijab bans are illegal. Then ask for an alternative, like a uniform scarf. If the ban is legal and there's no compromise, talk to a trusted scholar about your situation before deciding whether to stay, and keep looking for other work.
Know your rights
- USA: employers must reasonably accommodate religious dress unless it causes "undue hardship." The Supreme Court strengthened this in 2023 (Groff v. DeJoy). Contact the EEOC or CAIR if you're told to remove your hijab.
- UK: the Equality Act 2010 protects religious dress; a ban must be proportionate and genuinely necessary. ACAS can advise.
- EU: the Court of Justice (2017, 2021) allows private employers to ban all visible religious, political and philosophical symbols if the policy is genuine, applied to everyone, and meets a real business need. A ban targeting only hijab is still discrimination.
- France: public-sector workers can't wear religious symbols at work.
Try alternatives
Before accepting a ban, ask in writing whether:
- a scarf in company colors or a branded cap would be accepted,
- you could move to a role with less public contact,
- a smaller style, like a turban with a neck cover, meets their concern.
Many bans turn out to be a manager's assumption, not company policy.
If the ban is legal and firm
This is a heavy situation. Scholars weigh obligation against necessity:
- Many say you should look for another job, since hijab is a clear obligation and work can be found elsewhere.
- Some allow staying temporarily if losing the job would cause real hardship, like being unable to pay rent or support children, while actively searching for alternatives.
Talk to a scholar who understands your country and finances. Your situation is between you and Allah, and He knows your circumstances.
Trust Allah
Many sisters who left jobs over hijab found better ones. Allah promises a way out to those who fear Him (Quran 65:2). See Can I wear hijab to a job interview? and Can I take off my hijab at work?
- Many hijab bans are illegal; check first.
- Ask for alternatives in writing.
- If the ban is legal, scholars differ on staying.
